2. SMS/MMS Mobile Message Program Terms and Conditions

Porter House Party offers a mobile messaging program (the “Program”), which you agree to use and participate in subject to these Terms and Conditions. By opting in to or participating in our Program, you accept and agree to these terms, including, but not limited to, your agreement to resolve any disputes with us through binding, individual-only arbitration, as detailed in the “Dispute Resolution” section below.

• User Opt-in: The Program allows users to receive SMS/MMS mobile messages concerning reservations, promotions, updates, and other relevant information from Porter House Party.

• Express Consent: You consent to receive recurring marketing and informational text messages (SMS/MMS) at the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. You understand that consent is not a condition of any purchase.

• Message Frequency: The number of messages you receive will vary.

• Message and Data Rates: Message and data rates may apply to each text message sent or received in connection with the Program.

• Stop/Help Instructions: To stop receiving text messages, text STOP to the mobile number from which you received the message. You will receive a one-time final message confirming your unsubscription. • Termination: We reserve the right to modify or discontinue the Program, temporarily or permanently, with or without notice.

3. Dispute Resolution and Arbitration

Any dispute or claim relating in any way to your use of the Program will be resolved by binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify. The Federal Arbitration Act and federal arbitration law apply to this agreement. There is no judge or jury in arbitration, and court review of an arbitration award is limited. However, an arbitrator can award on an individual basis the same damages and relief as a court (including injunctive and declaratory relief or statutory damages) and must follow these Terms as a court would.

4. Limitation of Liability

We are not liable for any delays or failures in the receipt of any mobile messages connected with this Program, as delivery is subject to effective transmission from your mobile network operator.
